Terms of Service

1. Preamble

1.1. www.rembg.com (the “Platform”) is a web-based application for editing photos, operated by RemBG Deutschland, Schönstraße 51, 13086 Berlin, Germany (the “Operator”). These Terms of Service apply to all users of the Platform (each, a “User”).

2. Rights of use

2.1. The User may use the Platform, and the results generated through it, for both personal and commercial purposes, subject to compliance with these Terms of Service and all applicable laws.

2.2. The Operator has the right to restrict access to the Platform or to block Users, with or without giving reasons.

2.3. By accepting these Terms of Service, the User agrees that the Operator may store the User’s IP address in order to detect and prevent excessive or abusive use of the Platform.

3. Rights and obligations of the User

3.1. The User undertakes to refrain from any action that endangers the functionality or operation of the Platform. In particular, the User must not scan or test the Platform for vulnerabilities, circumvent its security measures, gain unauthorized access to its systems, or introduce malware into the Platform.

3.2. The User warrants that they hold all rights necessary to process the photos they upload, including any applicable copyright, ancillary copyright, industrial property rights, and trademark rights.

4. Warranty and liability

4.1. Any warranty for the results produced by the Platform and for its availability is excluded. Where a warranty claim nevertheless exists, the warranty period is one month.

4.2. The Operator is not liable for the speed of the Platform, its availability, data loss, or the correctness of its results. Beyond this, the liability of the Operator is excluded unless the damage was caused intentionally or through gross negligence. This limitation does not apply in cases of loss of life or injury to the health of a person.

4.3. Except where liability cannot be limited by law, the Operator’s total liability to a User is limited to the total amount paid by that User to the Operator in the twelve (12) months preceding the event giving rise to the claim.

5. Confidentiality and data protection

5.1. Information on how the Operator handles personal data is available to the User in our Privacy Policy.

6. Concluding provisions

6.1. This contract is governed exclusively by the laws of the Federal Republic of Germany.

6.2. The exclusive place of jurisdiction for any disputes arising out of or in connection with this contract shall be the competent court in Berlin, Germany.

6.3. Changes and additions to this contract must be made in writing to be valid. This written-form requirement may itself only be waived in writing.

6.4. Should individual provisions of this contract be or become void, unenforceable, or invalid, the validity of the remaining provisions shall not be affected. In such a case, the parties undertake to agree on a valid provision that comes as close as possible, in economic terms, to the purpose pursued by the void, unenforceable, or invalid provision.

6.5. Where these Terms of Service are presented by the Operator in a language other than German, the original German-language text shall prevail. If, in the event of a dispute, a court requires a German-language version of the contract, only the original German-language text shall be valid; under no circumstances shall a retranslation of a translated version be used.
